Condition 1 Terms and Conditions

1a	It is only possible to deviate from these general terms and conditions with the written permission of VeilingHuis De Jager Goes BV
1b	The general terms and conditions are made known to the auction visitors by a publication in the auction location prior to an auction and/or notification prior to an auction. Anyone who participates in an auction thereby indicates that he fully accepts the applicability of these terms and conditions.

Condition 2 description goods

2a	VeilingHuis De Jager Goes BV cannot be held liable for the accuracy of the description in the catalog or made known in any other way, of materials such as types of wood, fabrics, alloys, earthenware, porcelain, diamonds, precious metals, authenticity and dating.

Condition 3 bid and buy

3a	There is a definite sale when VeilingHuis De Jager Goes BV has accepted the buyer's offer and the object has been passed on to the buyer.
3b	All items are sold in the condition they are in at the time of purchase.

Condition 4 rights and obligations buyer

4a	The buyer is liable for payment without being able to rely on another.
4b	The buyer pays VeilingHuis De Jager Goes BV, within 48 hours after the moment of the auction (attack), the auction price, plus a 35% buyer's premium and € 2.00 lot money per lot, in cash, by debit card payment or by bank transfer. Cash payments over €10,000 will NOT be accepted.
4c	Ownership of the objects does not transfer until full payment of the purchase price. Objects that have not been paid for or have been paid for in full will be returned to the contributing party on the 29th day after the auction ( strike ). The purchase agreement is then deemed not to have been concluded. Partly paid single premiums will be deducted from the fine referred to in 4f.
4d	The buyer is responsible for the purchased item. VeilingHuis De Jager Goes BV is never liable for any damage or loss that occurs after the purchase.
4th	The buyer must take the purchased goods with him from the auction location on the day of the auction, unless otherwise agreed.
4f	If the buyer has failed to pay the purchase price due in time, the negligent buyer will pay VeilingHuis De Jager Goes BV, on account of damage suffered by it due to the non-going of the sale, after the expiry of the term of 28 days referred to in Articles 4b and 4c. days an immediately due and payable penalty of 35% to be calculated on your highest offer made at the time of sale, without prejudice to the right to additional compensation, if the actual damage exceeds the immediately due and payable penalty, and without prejudice to compensation of interest and costs of recovery .
4g	VeilingHuis De Jager Goes BV offers the service to ship lots, with a minimum handling fee of € 25 + shipping costs. VeilingHuis De Jager Goes BV is never liable for damage or loss as a result of packaging or shipment. All purchases from 1 bidder will be shipped to 1 address. Shipping to multiple addresses per buyer is NOT possible.
4h	The buyer is obliged to collect his purchased goods from the auction house or to have them shipped within 28 days after the auction. From the 29th day after the auction, storage costs of € 5 per week will be charged for each purchased lot, up to a maximum that is equal to the hammer price of the relevant lot. Ownership of the lot then reverts to VeilingHuis de Jager Goes BV, and the buyer is no longer entitled to the lot and the sum paid for it.

 
Condition 5 rights and obligations seller

5a	The seller is responsible for his goods submitted for auction until the moment of payment of the purchase agreement by the buyer.
5b	The seller is paid the highest bid on the goods brought in by him.
5c	€ 15 administration costs and € 15 per lot will be charged per contributor.
5d	The proceeds of the auction will be paid by bank, 28 working days after the auction, if the buyer has paid.
5th	If applicable, 4% resale right is charged on works of art to the seller.
5f	If applicable, a € 10 inspection fee will be charged for each untested precious metal item.
5g	Unsold lots must be collected by the seller within 3 weeks, otherwise VeilingHuis de Jager Goes BV can re-auction the lots without limit.
5h	The seller is obliged to collect his unsold lots within 28 days after the auction. From the 29th day after the auction, € 10 storage costs will be charged per lot per week, with a maximum of 12 weeks. Ownership of the lot then reverts to VeilingHuis de Jager Goes BV, and the seller is no longer entitled to the lot.

Condition 6 rights and obligations VeilingHuis De Jager Goes BV
VeilingHuis De Jager Goes BV can claim the following rights:
 

6a	To refuse persons as seller or buyer without giving reasons.
6b	Buy to combine or split.
6c	Don't buy or hold up.
6d	Correct errors in bidding and allocation.
6th	Submit bids on behalf of buyers or sellers.
6f	If the buyer has not ensured timely payment of the invoices, the buyer is in default without further notice of default. VeilingHuis de Jager Goes BV is then entitled to increase the amount due with interest based on 1% per month from the due date, without prejudice to an increase in the amount due with collection, lawyer, court and other collection costs, of which these costs are at the expense of amount to at least 15% of the principal sum.

Condition 7 Liability VeilingHuis De Jager Goes BV

7a	VeilingHuis De Jager Goes BV is never liable for damage during transport, storage and exhibition to the goods brought in as a result of fire, theft, weather conditions, etc.
7b	VeilingHuis De Jager Goes BV is never liable for damage to picture frames, other frames and everything that forms part of them, such as glass plates, passe-partouts, etc.
7c	Under no circumstances is VeilingHuis De Jager Goes BV liable for trading, consequential, capital and/or indirect damage.
7d	VeilingHuis De Jager Goes BV shall never be liable for any accident or any form of damage suffered by anyone in or near the buildings or sites where there is an opportunity for input, storage or viewing, where the auction takes place or where the sold goods are collected.
7th	Entering the buildings or grounds is at your own risk.
7f	After allocation, the buyer is responsible for the purchased item. VeilingHuis De Jager Goes BV is never liable for any damage that occurs after allocation.

Condition 8

8a	These general terms and conditions are exclusively governed by Dutch law.
8b	If there are any disputes, they must be submitted to a court and only the court of Zeeland-West-Brabant is applicable.
